Data Processing / GDPR Addendum

2. Roles & Definitions

  • Controller: The Client, who determines the purposes and means of processing personal data
  • Processor: Red Pixels Agency, which processes data on behalf of the Client

3. Scope of Processing

Red Pixels Agency may process personal data solely for the purpose of providing agreed services, including:

  • Website development and configuration
  • Form handling and integrations
  • Analytics setup
  • Hosting or technical support (if applicable)

We do not use client data for our own marketing or unrelated purposes.

4. Types of Data Processed

Depending on the project, this may include:

  • Names
  • Email addresses
  • Phone numbers
  • IP addresses
  • Form submissions
  • Website usage data

5. Duration of Processing

Data is processed only for the duration of the project and any agreed ongoing services.

Upon completion or termination:

  • Access may be revoked
  • Data remains under control of the Client

6. Processor Obligations

Red Pixels Agency agrees to:

  • Process data only on documented instructions from the Client
  • Maintain appropriate technical and organizational safeguards
  • Limit access to authorized personnel only
  • Take reasonable steps to protect data against unauthorized access, loss, or misuse

7. Subprocessors

We may use third-party services (“subprocessors”) such as:

  • Hosting providers
  • Analytics tools
  • Email systems
  • Plugin or SaaS integrations

We do not control these providers but select commonly trusted services.

8. International Data Transfers

Data may be processed in countries outside the Client’s jurisdiction, depending on the services used.

By engaging our services, the Client acknowledges that such transfers may occur.

9. Data Subject Rights

The Client is responsible for handling requests from individuals regarding:

  • Access to their data
  • Correction or deletion
  • Data portability
  • Objection to processing

We will assist where reasonably possible.

10. Data Breach Notification

In the event of a known data breach directly related to our services, we will notify the Client without undue delay.

However, we are not responsible for breaches caused by:

  • Third-party platforms
  • Client-managed systems
  • Weak credentials or misuse

11. Data Retention & Deletion

We do not retain personal data longer than necessary.

Upon request, we will:

  • Delete data within our control
  • Transfer data where applicable

12. Limitation of Liability

To the fullest extent permitted by law, Red Pixels Agency shall not be liable for:

  • Third-party data handling failures
  • Client misuse of systems
  • Improper data collection practices by the Client
  • Compliance failures outside our scope of services

13. Governing Terms

This DPA supplements and forms part of the Service Agreement.

If there is a conflict, the Service Agreement controls unless otherwise required by law.
