This Hosting / Server Responsibility Disclaimer explains the limitations of responsibility related to website hosting, server environments, uptime, backups, security, and third-party infrastructure used by Red Pixels Agency.
By using our services, you acknowledge and agree to the terms of this disclaimer.
2. Third-Party Hosting Services
Red Pixels Agency may assist with hosting setup, server configuration, website migration, or general hosting support. However, unless explicitly stated in a separate written maintenance or hosting agreement, we do not own or control third-party hosting providers, registrars, DNS providers, data centers, or outside infrastructure.
We are not responsible for service interruptions, outages, account suspensions, provider-side failures, or infrastructure issues caused by third-party vendors.
3. No Guaranteed Uptime
While we aim to build and configure stable website environments, Red Pixels Agency does not guarantee uninterrupted uptime, permanent availability, or error-free hosting performance.
Website availability may be affected by:
- Hosting provider issues
- DNS propagation or DNS errors
- Software conflicts
- Plugin or theme failures
- Server overload
- Security incidents
- Third-party outages
- Maintenance windows
4. Backups
Unless expressly included in a paid maintenance, hosting, or backup service agreement, Red Pixels Agency is not responsible for ongoing backups, backup retention, restore testing, or disaster recovery.
Clients are responsible for confirming:
- whether backups exist
- how often backups run
- where backups are stored
- whether backup restores have been tested
If we provide one-time backup assistance, that does not create an ongoing backup obligation.
5. Security Responsibility
We may implement basic website hardening, updates, or protective measures where applicable. However, no website, server, or platform can be guaranteed fully secure.
Red Pixels Agency is not liable for:
- hacking attempts
- malware infections
- brute force attacks
- plugin vulnerabilities
- third-party platform exploits
- client credential misuse
- failures caused by outdated software not maintained under an active service agreement
Ongoing security monitoring and remediation require a separate maintenance or managed hosting arrangement, if offered.
6. Client Responsibility
Clients are responsible for:
- maintaining access to hosting, domain, DNS, and registrar accounts
- keeping billing information current with providers
- renewing domains, hosting, SSL certificates, or related subscriptions
- safeguarding login credentials
- approving server or hosting changes when required
- understanding the terms of their third-party service providers
If a client chooses to manage hosting independently, the client accepts full responsibility for that environment.
6. Client Responsibility
Clients are responsible for:
- maintaining access to hosting, domain, DNS, and registrar accounts
- keeping billing information current with providers
- renewing domains, hosting, SSL certificates, or related subscriptions
- safeguarding login credentials
- approving server or hosting changes when required
- understanding the terms of their third-party service providers
If a client chooses to manage hosting independently, the client accepts full responsibility for that environment.
7. Maintenance and Monitoring
Unless specifically included in a written service plan, Red Pixels Agency does not provide ongoing monitoring, emergency support, patching, uptime management, or maintenance by default.
Any maintenance, update, monitoring, or server management work beyond the original project scope may require a separate agreement and additional fees.
8. Performance Variability
Website speed and performance depend on many factors outside our control, including:
- hosting quality
- server resources
- image sizes
- plugin usage
- caching configuration
- third-party scripts
- visitor load
- geographic traffic patterns
We do not guarantee specific performance scores or metrics unless explicitly agreed in writing.
9. Limitation of Liability
To the fullest extent permitted by law, Red Pixels Agency shall not be liable for:
- downtime
- data loss
- backup failures
- hosting suspensions
- DNS issues
- domain expiration
- SSL expiration
- security incidents
- lost revenue or business interruption arising from hosting or server-related events
10. Separate Agreements Control
If you have entered into a separate managed hosting, maintenance, care plan, or service agreement with Red Pixels Agency, the terms of that specific agreement will control to the extent they conflict with this page.
